Mediation is a voluntary, non-adversarial process in which a neutral third party (the mediator) facilitates negotiations between two parties to reach a mutually acceptable agreement. The mediator does not represent either party and does not make decisions—rather, he helps both sides communicate, clarify issues, and explore practical solutions.

How Mediation Works
- Initial Consultation: The parties meet jointly with the mediator to explain the issues and confirm that mediation is appropriate.
- Mediation Sessions: Guided discussions allow each side to express concerns and proposals, while the mediator helps identify points of agreement and resolve disputes. As necessary, the mediator will work individually with the parties to assist in their understanding of any legal issues.
- Drafting Agreements: If consensus is reached, a written Mediated Agreement is prepared, which can be reviewed by attorneys or filed with the court if needed.
- Confidentiality: all mediation proceedings are confidential, and the Mediator cannot be called as a witness or disclose anything said during mediation proceedings. This ensures open and honest discussion of the issues, without fear that something may be used against you if litigation subsequently ensues.
Mediation can occur with or without attorneys present, and may be conducted in person or remotely.
